Hello Fellow Dog Lovers,
Recently I was down to our place and my wife took a walk on the State Park beach. She saw many piles that were not picked up, it’s a shame to see this and gives non-dog owners a reason to hate dogs even more. It’s just plain wrong when folks don’t pick up after their dog. Just a reminder to bring a bag on every walk and please pick up and tell your renters or families that use your place to pick up after their dogs.
I’d like our private beach to be dog friendly with common sense rules like Dewey Beach. I think we have a majority for voting purposes.
Dewey Rules: dogs are only allowed on the beach before 9:30 am and after 5:30 pm, must be under control and leashed
I would recommend the following responsible and common sense rules for TS Beach:
1. Dogs allowed on the beach up to 8:30am and after 6:00pm
2. Dogs must be up to date on vaccinations
3. Dogs must be leashed and under control
4. Owners must bring a bag and clean up after their dog
5. Owners must be respectful of others and if asked keep a safe distance away from others who ask

I am a responsible dog owner and like your suggestion. We have no way to walk our dog on the State Park without walking partly on Tower Shores and it seems reasonable to allow us some time to walk the shoreline with our pets during the season.

The board needs to vote to make this item available to the community at our Memorial Day meeting. If you are friends with any board members please reach out to them and ask them to bring this up and second it so it makes the agenda so the whole community can vote on it. Otherwise we won’t have a shot.
The board keeps quoting that based on state law our beach cannot have dogs however that is not what the state law says. In addition the board says they are worried about liability yet the state law says each dog owner is 100% liable for a dog’s behavior. Now some of the board members want to hire an attorney to interpret the law. My feeling is to allow our community to share their feelings for or against allowing dogs on the beach and vote either way, in addition vote as a community to hire or not hire an attorney to interpret the law:
Delaware Code: Title 7, Chapter 17: Dogs
§ 1702 Dogs on state coastal beaches.
Whoever, being the owner, possessor, harborer or custodian of any dog, allows such dog to be upon the designated swimming or sunbathing area of a state coastal beach strand at any time between May 1 and September 30, inclusive, of any year, except when such dog is on said property on behalf of a law enforcement agency or a blind person, as defined in § 2101 of Title 31, is guilty of a violation and shall be fined not less than $25 nor more than $50. For each subsequent offense, the person shall be fined not less than $50 nor more than $100. “Coastal beach strand” shall mean all that coastal real property between the western base of the dunes and the low water mark except those lands within a municipality which has enacted an ordinance governing the activities of dogs on said real property.
Tower Shores is not a “designated swimming or sunbathing area of a state coastal beach strand.”
It is also not a “state coastal beach strand.”
It is a private coastal beach strand.
This state law does not apply to our neighborhood. The only reason dogs are not allowed on Tower Shores beach is because of a Tower Shores rule.
We can regulate dogs as we see fit – with a simple majority vote of the board, or a simple majority vote from the community (as long as a quorum is present).
Delaware Code: Title 16, Chapter 30F, Subchapter IV: General Provisions Concerning Dogs
§ 3053F Liability of dog owner for damages.
The owner of a dog is liable in damages for any injury, death, or loss to person or property that is caused by such dog, unless the injury, death, or loss was caused to the body or property of a person who, at the time, was committing or attempting to commit a trespass or other criminal offense on the property of the owner, or was committing or attempting to commit a criminal offense against any person, or was teasing, tormenting, or abusing the dog.

I would posit that the majority of dogs that folks staying in TS would like to walk on the beach in the early AM or evening during season are those of TS homeowners, who pay dues, respect our beach and our community. What will it take for the HOA to recognize the interests of all TS residents by allowing for flexible hours during season for dogs on the beach?

The majority of dog owners I speak to in TS feel that being to walk their dog on the beach would enhance their summer home experience and be a nice option to increase rental fees. Dog owners would like to walk on the beach in the early AM or evening year round and would respect our beach and our community. Maybe we can reach out to the rest of the community of folks who did not sign up for the new website – there are now 200 people who have yet to sign up to hear how they feel about this.

I agree with Brad, Marta, Owen & the majority of our Tower Shores neighbors. I fully support allowing dogs on the beach before 9 am and after 5 pm during the summer season. Our dogs are part of our families and there is no compelling reason for them to be totally banned from our private beach. The Delaware State law that often gets quoted (and misrepresented in order to hush these conversations) does not apply to privately owned beaches like ours. We are free to decide on a dog policy that works best for us.
Last years survey showed that more than 60% of owners are in favor of allowing dogs on the beach during certain hours.
We’re overdue for a community vote on this issue.
Can you think of a better way to get everyone motivated to sign up for the new website??

Appreciate your comments and agree. I recommend being on the upcoming monthly homeowner meetings to support the Dog topic being added to the agenda for the upcoming official vote.
With regards to motivating others to sign up for the website, I know Dan and Miles have sent multiple emails and care deeply about getting everyone signed up. I don’t know why others are not signing up, it basically takes 5 minutes. One good idea I thought of is to ask the representative of each association to contact their homeowner list by email and phone to sign up.

The Kraffts like the idea of allowing dogs on the beach in the early morning and late afternoon. It is, of course, essential that people clean up after their dogs.

My husband and I are also dog owners in Tower Shores and enjoy having her with us at the appropriate time. I agree that dogs should be trained and fully vaccinated and allowed to be on the beach in-season before 9am and from 4:30pm on when the beach use is quiet. Let’s bring up at this year’s meeting.

Our board needs to bring the matter up, make a motion and get it seconded to discuss dogs on the beach and make it one of the items for our community to discuss pros and cons to vote on at the memorial day meeting. The board will also try to postpone the vote in order to hire a lawyer to interpret Delaware State Law. Conversely, I believe we need the community to hear the laws, vote if a lawyer is needed, then hear pros/cos and vote with no delays.
